Me and my wife were fired the same day we lost our home. what can be done? Wife was manager?

Ok my wife was manager and I worked under her for 3 months and we were doing great paying bills making sales the whole 10 yards. well in one day home office shows up fires us all and they pack up all extra equip. and hardware and take off back to home office. They only said that they had to file for bankruptcy and there lawyer said this was best course of action. Well in the same day our landlord said we couldnt stay in our house anymore due to both of us losing our jobs and he kicked us out that night. We had no choice but to move in with my sister in law in another state. We had to take our 3 kids out of school. now we are job hunting again and I want to know is there anything legally we can do to our previous employer for the way they did us. They gave no notice nor any chance to find another job right then.

    Unless you had a contract for services or a union protection, a company that small can pretty much close it’s doors at anytme it chooses in most states.

    Talk to the NLRB.

    If you had a contract for a specific period of time, then you can file a claim in the bankruptcy court. If you had no such contract, and you were free to quit at any time, then the company was also free to terminate at any time. BTW, your story makes no sense. The part about the landlord evicting you in one day, because you might or might not be able to pay the rent in the future, rings false.

    Actually, it would be your landlord who did something wrong. If you have a lease, they shouldn’t be able to kick you out until you miss a month’s rent. Check your old lease.

    No, but your previous landlord couldn’t throw you out if your rent was paid without an eviction notice.

    Probably no recourse on the job firing. If you weren’t behind on your rent, though, I don’t know how the landlord could throw you out that night. It seems like the world did you wrong, but I can’t think of a specific valid complaint that you have. Take care of those kids.

    Sorry for your hard luck…but if my landlord tried to throw me out in one night I would take him to court that is illegal and he can not just throw you out that quick, unless you were already in process of eviction for not paying. How did he know you if you would have found a job the next day or you and your wife file for unemployment you get this if your company files bankruptsy. TAKE HIS BUTT TO SMALL CLAIMS COURT!

    What your employeer did was legal. They don’t need to give notice if they are bankrupt. Now your landlord is supposed to give at least 30 days notice. YOu should not of been kicked out until 30 days after your first missed rent. You are owed money from him.

    Your employer has no obligation to you, however your landlord does.

    You landlord cannot kick you out without going through a formal and legal eviction or notification process.

    What you landlord did was illegally evict you and you can Sue him for that, however your employer has no obligation to you.
