Supreme Court Rules in Bankruptcy Case

WASHINGTON (AP) — The Supreme Court ruled Wednesday that a financially troubled small businessman gave up an important right under the federal bankruptcy code because he failed to disclose all of his assets as the law requires.
In a 5-4 decision, the court said Robert Marrama of Gloucester, Mass., could not convert his bankruptcy case from one chapter of the code to another, as the law ordinarily allows.

Well, I’m not going to read - whatever - but, I can tell you that if you are filing bankruptcy, you must disclose ALL your debts. Many people try to hold back something - usually a credit card that they don’t want to lose. If you do that and are caught…….all bets are off and you are stuck…
So,no, he hasn’t been given the shaft….he has tried to file a fraudulent bankruptcy claim….

A vacation home is not the same as a residence.

He did it to himself, the article doesn’t mention his debt or the value of the vacation home.
It says small business. That could mean he is filing bankruptcy on a 2 million dollar business and isn’t disclosing a 1 million dollar vacation home.

He tried to file under the wrong chapter. His attorney should have realized this before he filed
