Charged off accounts?

bankruptcy law

I have a charged off account that I stopped paying on in 1999 because I filed a bankruptcy during that time. Now my accounts are up to par except this one account. It went to charge off status in 2004. Can an account begin charged off status after 5 years? And I thought this account was included in my bankruptcy and I though by law charge off’s take place after 180 days.

If you had a bk attorney you need to recontact and seek their advice. If it was included in your bankruptcy and discharged you are released from your debt.

They can put the status of charge off anytime. It the business’ decision when they decide to ‘write it off’ of their AR books. If it was included in your bankruptcy; you need to consult the lawyer that took care of that for you and double check. If it was; you can request it get taken off of your credit report.

Did you list this account when you filed bankruptcy? If not, it wasn’t included. Check your documents to see what debts you listed when you filed. If you can prove that debt was discharged, send a copy of the document to the credit company and tell them to correct the report.

Sometimes old debts are sold to new collection companies, and sometimes those debts aren’t valid, but you’ll need proof to back up your claim.

sounds like it was never on your bankruptcy, but most likely
    past the statute of limitations
