Chapter 7 bankruptcy?

Hello guys. I was wondering if anyone could answer this question for me. Under the new BK law, you cannot file Chapter 7 BK if you got a discharge less than 8 years ago. My question is…Is it from the time that you filed 8 years ago or is it the month you received a discharge 8 years ago? Because I filed for BK in 4/99(Which would be 8 years next month) but I received my discharge 7/99(Which would be this July). Just kind of confused on the 8 year rule. Thanks guys

    From the date of discharge, not the date of filing.

    Are you considering filing again?

    Perhaps you should meet with someone who can help you with your finances. Nobody should be declaring bankruptcy once in their life, nonetheless twice.

    They changed the laws because too many people were using it as an escape out of racking up their charge cards and bills. Chances are if you have declared Chapter 7 bankruptcy once, despite waiting the 8 years, you may still have a very, very hard time declaring it again and you will more than likely be pushed towards a different Chapter of bankruptcy in which you repay any debt you owe.

    The 8 years is measured from the date you filed the last bankruptcy case.
