Can the LAW Ca. send my sister in law in prison for assault like this?
My Sister in law had an affair for over 2 years ( I strongly don’t approve)
and her husband found out.
He got evidence that proved the affair existed without question, so he contacted the D.A. and filed ASSAULT CHARGES against her for depraved indifference.
She got arrested, and now faces up to 3 years in prison for her actions.
A plea bargain 6 months but felony record and she will lose her job, in her field of education and reduced to a wage jobs.
Worst she will lose her child because of the Felony statues.
Can the D.A. do this, and could this be a ploy to pay back his wife?
If this happen I’m told he could take her to civil court and win everything from the marriage, and send her to bankruptcy is that possible too?
She’s “WHITE TRASH” but I feel for her situation why?
IS this right, I see both sides and think maybe, and then maybe not

Odds are she will lose everyting in divorce court especially if her X can prove the affair.
She could be fired from her job depending on whether or not the school has some form of morality clause.
I never heard of being charged with a felony for being white trash.

It will all come out in court. Any “legal” answers here will be purely speculation because we don’t have evidence, testimony, or know what the judge will decide. I know you feel for the situation she’s created, but in all honesty, I would stay out of it and let it be their battle. There’s really nothing else you can do. Such a sad situation.

wow … you should let us know how this one comes out .. .might be a new precedent that women could start using against all the men that do this.
i think she needs a really good attorney . maybe she needs to have some dirt against him too . or invent some dirt. lol.
hard question. who is to say that they did not have a open marriage and he allowed her to go out with other guys ?
then changed his mind ?

Something is not honest in this whole story. Most likely, you do not know the whole situation as to what had actually happened. Who did you hear this story from?? From your husband????? Ha-ha, everything is clear then! Can it be his way of sending you the message: “See, that’s what “happened” to her! Don’t ever cheat on me or same will happen to you!” lol
I am surprised at the criminal charges. If the charges are as he described, her husband will look like an idiot in the court. Felony guilty plead for cheating? : ) I can sell you water! She got arrested for aggravated assault that was NOT based on the emotional abuse/
In California, even if she had slept with the entire street all her marriage long, all the assets acquired during the marriage will be split in half, plus the spousal support will be awarded to her if needed.

That’s bullcrap. The ONLY way she could be charged with this is if she tried to hit him or harm him in any way. …are you SURE she didn’t try to hit him or something like that?
Edit: Ok, this can be quite interesting because this can be considered to be “depraved indifference” assault. Giving someone a STD can cause great bodily harm and can even lead to death…so there is your answer. The only thing would be how would he prove this? Does have the medical records to do so? Were her records supeanoed? don’t answer that..just consider that might be the case why she is being charged with this. Unless the DA is overzealous that is..
