I know a person who is separated and is waiting for a divorce to go through but his lawyer said that the soon to be ex wife is protected by the law and cant be bothered by lawyers due to the bankruptcy. I thinks its a bunch of bologna but i have heard some strange things that turned out to be true.

I don’t know but I have a niece who filed for bankruptcy with her husband and is now getting a divorce.

His lawyer is correct, except not for the reason stated. Divorce, by it’s nature, is an advisary proceeding of property and marital interest. If one party has file a bankruptcy then the divorce must be put on hold until the other party’s interest and ownership interest in the subject property is settled by the bankruptcy court.
