bankruptcy -spouses seperately filing?
I am interested in having my wife file ch.7 without my7 name or without me having to pay her debt. Is this possible, if we are living in seperate apartments due to job locations and her home? (and would it matter if we lived seperately or not)?
The debts she had incurred was long before we had married and my name was not on any of it. How does this work in terms of the law and would i be responsible at all?
thanks…10 points best answer

think cos you are now married then yes they can come to you for cash ,, or goods ,, even if it was before you both got married ..but there again it might change cos your wife had dept before you got married,,easy enough to find out phone ayour solicitor up and ask him or just any one ,,
BUT the bankruptcy rules change all the time ,,
Mind you i have a friend whos live in patener has gone bankrupt,, and they have not come to her for any thing ,, so as i said check the system out ok vivi

You don’t say where you live. In the States, there are 3 main sets of rules depending on if your state is a Common Law, Community Property, so on so forth. Some states would hold community property over the chopping block to settle the debts, meaning the debts are joint. Short answer, call the attorney that others recommend for bankruptcy.
