Quick Answers to Bankruptcy Questions & Understand How Bankruptcy Laws Affect You

A question about Bankruptcy?

bankruptcy law

I know you have to do the ‘ticket in’ as one of the new California laws but do you have to be in collections before you can do the ticket in?
And after doing the ticket in do we have to wait an entire 6 months before filing chapter 7?
Are there any links that I can access with this information?
I’ll greatly appreciate any help I can get concerning this matter.
Thank You Gillian.
Unfortunately we don’t have any other alternative.
Thanks to the housing market.

You have to have had credit counseling before filing bankruptcy. The collection status of your bills is not important. If you think you want to file, you should contact a bankruptcy attorney. It is no longer a DIY project.

No, you do not have to be in collections. If you are sure you are going to file, it’s best to do it ASAP.

If you are facing bankruptcy there are two things you need to do.

    1. Find out if there is any alternative. It may be that there is a way to reschedule your debts that will let you avoid bankruptcy. If there is an alternative, take it because bankruptcy is not nice.

    2. If there is no alternative, take action sooner rather than later. The new laws make it very complex and you need to consult a qualified bankruptcy attorney. They will help you comply with the law and deal with your creditors.
