bankruptcy law

I recently lost a court case and the other lawyer is coming after me for attorney fees and court costs. It could total over $70,000.

I was told by lawyer that if that happens, I could file for Chapter 7 bankruptcy….. but six years ago I had to file Chapter 7 due to an illness. Now I understand that the new bankruptcy law changed it to 8 years. So I can’t file one until 2009.

SO what happens when they get a judgement against me? Will they come after my property, home and garnish my wages????

Please help me on how to get out of this mess. Thanks.

Vatican Immunity. Are Catholics proud of their Church?

Roman Catholic Church is Abusing Bankruptcy Laws:

Lawyers Suing Vatican Call For A Public Audit

The Archdiocese of Portland, Oregon recently announced plans to file for bankruptcy due to millions of dollars in potential debt to sexual abuse survivors. Now the Diocese of Covington, Kentucky and others are lining up to do the same. However, the Vatican and its myriad branches: Dioceses, Orders (Franciscans, Jesuits, etc.), and tens of thousands of tax-free organizations all answerable to Rome control multi-billions of dollars in property, artworks, and hard assets like gold, cash and securities.

Last year former Governor Frank Keating likened those who sexually abuse and cover up in the name of the Church as Mafia. He was right on the money; the real Mafia has infiltrated the Catholic Church. Just one example is the Vatican Bank, nominally owned by the Pope. The Vatican Bank operating with diplomatic immunity has been mired in one criminal scandal after another since it’s current incarnation in 1942. Now it faces not only our lawsuit (Alperin vs. Vatican Bank) seeking stolen Second World War assets but also a nearly $1 billion dollar lawsuit by five state insurance commissioners for money laundering in connection with convicted swindler Martin Frankel. The number three man at the Vatican, Cardinal Sodano is implicated that conspiracy.

In the United States, the Archdiocese and Orders have covered up crimes and enabled a legion of pedophiles. The so-called lavender mafia now seeks to hide behind the United States bankruptcy courts. But should an enterprise infiltrated by criminals be allowed to shield themselves in this manner? The answer is a palpable NO; instead the entire Vatican apparatus should be stripped of its non-profit status here unless it submits to a public audit. We guarantee parishioners will be shocked when they see where the money went and that the Church’s abuses of trust will end in short order once their full extent is revealed.

The lawsuit, Alperin v. Vatican Bank, was filed in November 1999 by Serb, Jewish, and Ukrainian Holocaust survivors against the Vatican Bank seeking return of Nazi loot from wartime Yugoslavia has run into an apparent wall of silence. Tom Easton and Jonathan Levy represent 28 plaintiffs suing the Vatican Bank, the case is currently pending in the Ninth Circuit Court of Appeals in San Francisco.

College Major is Accounting possible PHD but filed bankruptcy what should I do?

bankruptcy law

Filed bankruptcy a year ago because of a bad business venture. I am currently in college with a major in accouting but I am getting worried that I won’t be able to use my degree in accouting with a BK. I am only in my second year so I could easily change majors at this time. I do have an interest in Med-school, law-school and accounting PHD. My question is should I keep going with my accounting degree and get my PHD in accounting. I would like to teach I think but worry that it will be hard to find a job after getting that degree that took me 8 years to get?

my freind was married for 2 years & divorced. They had a house. Separation agreement ordered it go up for sale and each pay half the mortgage until sale. It’s been a year, no sale and she is in default for past 8 months.

He’s tried to work with her an not file contempt charges. She turned around and filed chapter 7. Will the fed court relieve her of this debt – leaving him to pay it all? Her name is on mortgage too. Can she get off the hook even if her name is on mortgage? Thanks much.

Is $4,500 credit card debt too little to file bankruptcy?

bankruptcy law

It seems like a small amount, but with hardly any income and rising late fees it’s getting no where. My credit is already ruined – I don’t think the bankruptcy will hurt it that much more. Would it be hard with the new laws to file and wipe the debt out?
I no longer have any credit cards….everything is paid with cash. I will never again get a credit card.
Is it worth it to do it or would it just hurt me more in the long run?

Is there any law that says you can’t cash out all your lines of credit+cards and then save the cash in a box?

Right now I have $150K of available credit through a variety of sources. My good credit score is about to be trashed because I can’t afford my mortgage reset after 5 years and there is negative equity in my home so I can’t refinance. Since my credit score will be destroyed can I cash out the $150K since the damage is already done? How long will it take for the debt to be discharged from my record? If I keep the cash in a box and don’t declare bankruptcy to say that I don’t have the cash, what is the worst that can happen to me?

Should there be a law concerning credit related lawsuits?

bankruptcy law

Now that congress has passed the new bankruptcy laws that do not allow credit obligations to be totally wiped clean, this has given creditors free reign to file lawsuits for bad credit. The amount of lawsuits are jumping high as it is forcing people to file bankruptcy which under the new rules forces them to pay regardless. This use to be bad policy for creditors as it created bad business for consumers.

Do creditors have right to sue consumers with money they have made off of consumers? Should credit be regarded as an investment made by a creditor to a consumer and if that investment goes bad to not cry about it? Are in likewise manner people allowed to sue companies and stock brokers if our investments are lost for one reason or another? So if that cannot be allowed should corporations be allowed to sue consumers for their own bad investments?

Should this be allowed or should congress amend the law to disallow lawsuits for credit obligations?
