Can a creditor list an account as “in collections” to the 3 major bureaus, that was included in a Chapter 7 ?

My bk is 1 year and 4 months old and I just pulled my credit report after being turned down for a credit card, to find that my previous debts were not changed to “included in bankruptcy” but still report as “in collections”! Is this hurting my credit report? The accounts are listed as closed, but they still show a balance! Can this be fixed? Am I protected by the bankruptcy laws?

I will probably be sued by the credit card companies. I owe about $120,000 spread over about 11 cards. I have no way to pay them back and because of the new bankruptcy law I don’t qualify for that either. I am sure they will eventually sue me for the debt and get a judgement against me. My question is, when this happens will the interest stop on the debt? How much of my income can they garnish? I’m in California if that makes a difference.

Anyone that can help would be great.

I need to replace my friends attorney.(with his permission) I live in another state and have no idea how to check on lawyers to see if they are any good…the one my friend has know , turns out to be a bankruptcy lawyer and knows zip about criminal law or just doesn’t give a hoot….either way, we need to replace him! How and where do I get backround info on lawyers?

Over the past three years I have systematicly been “swindled” out of almost $20,000.00! I even have a report from a PI showing that ALL the transactions were based upon this person’s deceptions, yet local Police will not even take the complaint!

To make matters worse, I am STILL being RIPPED OFF by this persons’ deceptions (Insurance Fraud now), yet no assistance in stopping these actions.

This CON ARTIST has brought me to the verge of Bankruptcy! The emotional stress is ruining my health, and even my ability to even sleep anymore!

I find myself “fantasizing” about doing “physical harm” to this person I am becoming so desperate to put an “end” to all of this.

Is there any recourse, (short of “taking the law into my own hands”)?

The Landlord agrees too give the Tenant right of being the first option to buy the Leased Property at tax assessed value after total costs of renovations are applied due to Landlords death , bankruptcy , forced asset auction or other decision to sell Tenant has two(2) years to exercise said option if Tenant does not exercise the first sale option the lease is considered terminated and Landlord agrees to fully refund all renovation costs to the seller upon closing of the sale and agrees to set sale price of the Leased property to include total renovation costs except bankruptcy where as Tenant aggress to follow the guidelines set forth as the state or federal bankruptcy laws dictate

I am in a financial hardship right now. I mean gas going up, food going up, hit with an 1200 dollar car repair, my job cut overtime. But I had stopped paying creditors a long time ago and have been wanting to file bankruptcy but just couldnt afford it. But now I got a letter from a law office in my state who is saying I am being reviewed to confirm my place of employment, any assets or property of value for a potential lawsuit and if my wages were garnished I would be screwed!

But I do have about 1140 and I know that is to small for a loan and I know cashing out is not a good idea with taxes but I kind of have no choice here as I cannot borrow that kind of money from anyone. But my question is, if I cash out will I get the whole 1140.00 and be responsible myself for paying taxes, or will they take taxes and give me what is left? And if it is the second how much would I have left?
