I am a first-time home buyer, and I was overwhelmed by the whole transaction. Are sellers required by New York law to let prospective buyers know if they are going through bankruptcy? I did not find out about the seller’s bankruptcy until after escrow was opened, when I received some paperwork from the title company. There was then an enormous hassle getting the approval of the Bankruptcy Court to sell the house to me.
Ok any solusion to this situation? my loan time running out and my interest rate lock expired as of to day 7/21/06 and the bank telling me that I have to pay $1400(1/8 of a point ) to keep it good for another 30 days … but there is no sign that the clossing day any time soon. Contract is up on 8/15…any advice PLEASEEEEEEE HEEEELP

i am going to see a lawyer to try to stop my foreclosure tomorrow . my end date is july 3,2007. if i have loans that i am not the primary account holder do i need to take those to show the lawyer as well or do they not count to file. if by any chance i get a petition from the lawyer to the court by the end of day tomorrow will it stop the sale of my property the next day. people in my city are waiting for my house to forfeit. that sucks because i put alot of money to it. i am trying to sell the property to make a profit and bankruptcy is my last resort to pocket something. if i read correctly texas law states the courts can only take profit money only if i exceed over 15,000.00 in profit to satifsy my lenders . is this true… please help tomorrow will be a long day of ass kissing

Here it is, I was considering filing for bankruptcy and found a firm online that offered a free initial consultation. Half way through my initial consultation I was asked to pay a $500 down payment for a retainer fee for this firm to file bankruptcy papers for me. The phone call lasted about 1 hour. After hanging up I read some info that the bk attorney emailed me and decided that I was not ready to file for bankruptcy. I called the firm back asking for a refund as I had changed my mind, it was less than an hour since I hung up from my initial consultation, so I didn’t really expect it to be a problem. The attorney told me they would not give me a refund & if I tried to stop payment they would sue. Well, I hung up, called my bank and stopped payment and now 2 weeks later they are calling me and threatening “legal action”. My question is should I really have to pay them? They didn’t do anything other than the initial consult which was supposed to be free.
I live in California and I did not sign anything. I was not even sent anything to sign. The reason I say he did not do anything is because I did not sign anything that would allow him to start paperwork on my behalf. And as he did not set up any future appointments with me I fail to see how he could have turned down any other clients due to my “retainer”

I’m curious why you think I’m in the wrong. Doesn’t a customer have the right to change their mind? Especially within a 24 hour period?

If I go into foreclosure. If my home goes to auction do I owe the amount of the loan remaining?

Or is it better to do a short sale..does this mean the bank will take whatever the home sales for as a settlement? I’m really confused but I got seperated and can no longer afford my home..what is the best options? Or is bankruptcy a solution? Although I heard with the new laws it’s not so easy anymore. I would still owe most of it. Is this true?

If someone has bad credit, or even a bankruptcy on their record?

but later wants go onto law school (I know, it sounds impossible). Anyway, is the legal field one of those fields that rejects a job candidate because of the bad credit / bankruptcy?

Just wondering because of the accounting that they may have to do for billing clients.

I suppose this could go under the careers & employment category, but has to do with credit as well.

Messy Lawsuit between divorced couple, now kids are involved?

Okay, here’s the short version: My mother in law marred a very weird man (we’ll call them Sally and Bob) when my husband was 10. My husband (we’ll call him Pete) and his sister were adopted for insurance reasons. So now the kids have Bob’s last name. When my hubby Pete was 16, Sally and Bob got divorced. Bob was/is a very weird guy. The divorce was very messy and Sally told Bob never to talk to the kids again. When the kids where adults they also told him (bc he still tried to contact them) that they didnt want anything to do with him. So fast forward to present day. Bob filed for bankruptcy and left Sally with HIS college debt - $15,000!! They are currently in a lawsuit for him to pay her back the debt. So now, Bob is back to harrassing the kids. Pete and I moved out of the state for his job, and Bob found us. Figured out our address (only god knows how!!) and mailed us a letter. Now he is emailing Pete almost everyday. **So much for short version. To be continued**
He has taken pics off of our myspace pages (just the first default pic, since you have to be a friend to view our whole page) and has posted them on his myspace page and his personal website. He has posted very personal information about Pete and his sister on his pages as well.

We havent responded to any of his letters or emails. We just wanted to ignore him. But that is becoming very hard to do.

Is it possible to get a restraining order because of this?
Because of the lawsuit that Sally and Bob have, Bob has been ordered not to talk to Sally outside of court. So we’re not really sure why he has picked this time to try to connect with the kids again. They dont want anything to do with him. I’ve never met him and he’s posted very odd things about me, about always wanting me as a daughter in law.
Yes Monk. We are keeping all of the stuff together just in case we need to give it to someone. We didnt want it to come to all of this, but I think you are right. We need to start fighting back.

And Dragonfly - about the address. Yep, we moved and two months later we got a letter. We arent even in the phonebook yet! No one has our address that would have given it to him. It really creeps us out that he would be able to track us down like that. We still dont know how he got it. But he was my hubby’s dad for awhile, so he has all of my hubby’s info, like SSN and such. Scary stuff if you ask me!!

Wiping out student loans in bankruptcy?

If I wipe out student loans in bankruptcy will my cosignor’s credit be affected? My mother-in-law cosigned on 2 of my student loans and she has A-1 credit. I am considering the option of filing for bankruptcy and trying to wipe out my loans in the process. I know it will show up on my credit report which is fine…I just don’t want to affect her credit in the process. Any info would be appreciated. Thanks.
I have found out that you can claim student loans in your bankruptcy if you can prove that you can’t pay them…so I need someone who knows the law to tell me if her credit will be affected?

What to do if landlord is up to fraudulent behavior using the personal information of others?

I recently applied for an apartment for rent by private owner. I provided my personal information when filling out the rental application. I now feel the woman never had plans to rent the place, and is using an “apartment for rent” as a front to obtain the personal information of others to commit fraud.

It turns out, my co-worker happens to know this woman personally, and says she recently filed bankruptcy, does not own the property, and was renting it from a relative.

What should I do? If the above is true, she’ll deny we met. This woman has my social security number, personal information, and more. Is there any way to tell when someone pulls your credit to apply for an apartment? I don’t think those type of credit inquiries appear on credit reports.

What should I do to prevent fraudulent behavior? There are Michigan laws protecting landlords, what about those for tenants?
