this is a serious question about bankruptcy or trying to avoid creditors?
Sunday, May 31st, 2009i had really good credit until a few years ago, i had all the major credit cards and i always paid my bills on time. but i was unemployed because of an injury for almost 6 months so i just lived off of my credit cards, when i finally got back to work i wasnt even making enough to pay all late charges and interest fees. i was paying 50% of my income each week towards paying it back but i was so far in debt by that time that i was still having each account grow in debt because i got so far behind. they were calling me at work constantly , i didnt even have my home phone because i got rid of any luxurys that i didnt need. i ended up moving out of state to avoid them. i understand there are new laws that prevent a person from filing bankruptcy on credit card debt. it has been over 2 years now that i have avoided them. but my debt was about $15,000 back then and the way it was growing im sure it has to be double that by now. should i continue to try and avoid them. i earn only $16000 a year
i would really like to pay it all back but i couldnt even keep up with the late fees back then and i have a job making less than i made before. is there any way that i could just pay maybe 20% of my income and get my debt paid off? i am barely scraping by now but i dont want to be a deadbeat. but i have also heard that if i avoid them contacting me in anyway for 7 years that they will not be able to collect anything from me. but im sure that they can find me because i work at a normal job and file my taxes every year
Consequences of filing bankruptcy as a law/accounting student?
Saturday, May 30th, 2009I’m in my 2nd year of a 5 year accounting and law degree in Australia. Pretend I have gotten myself into serious debt (let’s say.. $60 000), and I filed bankruptcy.
How would this affect me when I graduate in november 2011? Would law firms and accounting firms not want to hire me? (Or are they not allowed to even ask me if I’m bankrupt). Also, would the professional bodies that accredit me as a lawyer/accountant upon completion of my degree, not do so due to my being bankrupt?
Bankruptcy in Scotland - Self Sequestration?
Friday, May 29th, 2009A friend of mine who lives in Scotland has no job, no assets and thousands of pounds of debt.
She wants to make herself bankrupt, however Scottish Law states that in order to apply for self-sequestration, one of her creditors must have served her one of the following :-
1. a Charge for Payment and fourteen days notice have elapsed or,
2. a Statutory Demand and 21 days have elapsed or,
3. an Earnings Arrestment as a result of a Charge for Payment.
She has received a letter which is titled “Default notice served under section 87(1) of the Consumer Credit Act 1974″
They have given her until the 16th January 2008 to pay the outstanding amount otherwise they will close her bank account and “may take legal proceedings and/or instruct a debt collection agency to recover any outstanding amount”
Does anyone know if this letter is considered a “charge for payment” or a “statutory demand” as per the above ?

Marie C - I appreciate your help, but that doesn’t answer the question. I didn’t ask what other options she has. Also, as per my opening paragraph, she has no house, car, or any other assets at all.
Anyone a student, and filed for Bankruptcy, or know anything about this?

I say the answer is false because the bankruptcy court has to make sure their local court rules don’t go against the Supreme Court rules. Furthermore, aren’t the local court rules for each specific court? Meaning that bankruptcy court ‘A’ could have different local rules that bankruptcy court ‘B’?

Friday, May 22nd, 2009My home went into foreclosure, I filed for bankruptcy, Ch 13, using an online company, that was to submit to the appropriate motions to the court, etc. after I completed all necessary forms. To make a very very long story short I was scammed, and the bankruptcy was not filed prior to the sale date which allowed the bank to purchase the house. So now on top of the law suit against the fake “online company” I must now either leave the property or put an offer to the bank for the house. I don’t know what I should do or even can do…help me …please
