What is this new bankruptcy law in Maryland?

I was told that in order to file chapter 7 bankruptcy in Maryland, you have to prove you can’t pay the debt. What proof is needed to show this?

What are the consequences to bankruptcy? I keep hearing the laws have changed?

I have been in debt since I was in High school and its fairly safe to say my plan to get out of debt is not working. I am 28 and I am trying to finish my last 2 years of college but my high debt is making almost impossible since I have to work full time.

-My questions are:
-How does this affect my current and future student loans?
-Do you ever REALLY recover from bankruptcy??
-The consequences?

Can someone help me with these questions or point me in the right direction?

Two years ago I worked for a company that went bankrupt and now they keep mailing me reports from the court hearings because appearently the case hasn’t been closed. All this law & court stuff is mumble-jumble to me…what are these documents? And what do I do with them?

We are in debt 30,000K and have an income of 36,000K. We pay $1400 in rent and $950 in revolving credit a month without gas and food and utilities. We are not making it. We filed bankruptcy 8 years ago when my hubby lost his job right after me losing mine. With all the law changes, are we even elgible to file chap 7 again? I hear to stay away from Credit Counseling….and I cant find a debt consolidation loan that we can get without collateral. Does anyone know a way to help us? If something doesnt happen soon we are going to lose everything anyway. HELP!!!!

I just lost both of my cars that I was paying a total of $841/mo. on. My wife is going to be quitting her job because of childcare issues, tension levels in the family, and all the stress that’s been building up from playing “tagteam” with watching the kids over the past 2 months. I get at least 15 calls a day from credit card companies asking where their money is. I incorrectly filed my taxes in 2005 (filed a Schedule K-1 online with Liberty Tax, and apparently I was missing a Schedule E form), so now I have a tax debt of almost $10,000. I will be making just enough money to pay my mortgage, utilities, food, and gas for commuting to and from work (70 miles a day). I am behind on every credit card I have, a Home Depot Consumer Loan, student loans, medical bills, everything. I also live in a suburb of Austin, TX in case anyone was wondering. I don’t know the bankruptcy laws well enough in Texas, and I need major help. Should we file for bakruptcy, and if should which kind of bankruptcy?
I believe most people are thinking that I’m a big spender, but I’m actually more of a tightwad. I don’t buy latte’s at all or have any weekly or daily habits with spending money on food, my wife cannot work due to the fact that everything she makes goes towards paying for childcare, and even still we’re short. I am a general manager of a restaurant, on salary, and I cannot get another job because I have to have open availability. I lived on credit cards and did things like paying my water and electric bills with them, not going out and buying a big screen tv or anything of that sort. Like I said,I am relatively frugal, it’s just childcare mostly that screwed me and now I’m up to my ears in debt because of the decision for my wife to stay at work.

I ran up more debt than I could handle a year and a half ago. Right now, I am paying back two of them, and combined with my other bills, is leaving me with not much leftover. Another creditor (I owe them $5000) hired a law office who is bugging me for $, but I can’t afford to give them payments every month, too. If I pay nothing, the debt will be off my credit in 4 1/2 years, but I risk them taking me to court. If I make small payments, it will take forever to pay off (they’re still charging interest), and will be on my credit even longer. Should I file bankruptcy? What should I do?

Hubby filed a bankruptcy, chap. 7 and included a debt owing to an attorney that did not do a job properly that caused his pay to be garnished. Had the attorney did the job properly, hubby’s pay would not have been garnished and the attorney woulda been pain in full like she had been prior to.

So now the attorney that he filed on did not stop sending bills like she is suppose to do by federal law, she chose to not show up at the meeting of creditors. What recourse is available to my hubby? The attorney’s assistant advised me last year before the holidays that they do take clients to court for non-payment. This is a mess.

Some cases, such as bankruptcy and patent, are heard only in federal courts. Do you think that having exclusive jurisdiction by federal courts in these subject matters is a good idea? Why or why not? Some cases are also only heard in state courts. For example, most family law cases are almost always heard in state court and not federal court. Is this a good idea? Why or why not?
