I hired an attorney to represent my mother and sister in a dispute with her sister-in-law/aunt over the inheretence of a house.

I pulled the case files from NYS court system and discovered that our attorney failed to file an opposition brief to a summary judgement motion. The court granted the motion and my mom and sister lost. The attorney never communicated this information.

Also, I discovered that our attorney never communicated with the opposition in regards to our proposals.

In addition, several months ago, the opposition threatened to file a motion in US Bankruptcy court as a manuever to get the upper hand, (to complicated to explain here), and our attorney never communicated this information to us. The opposition did follow up on his threat and filed an action in US Bankruptcy Court.

I want to make clear, that we cooperated with our attorney and supplied her with all the information she requested and hid nothing.

What actions can we take against the attorney

First, the basics: I got married in Alabama, and now live in Georgia. I have been married for 4 years, and separated for two of those awful years. One year after we separated, I filed chapter 7 bankruptcy, which has recently been discharged. We are in the process of drawing up divorce papers, however, my soon to be Ex claims that because I did not include himself as one of my creditors in my bankruptcy, that he could try to collect the debt that we have accumulated together over the years, which he now is solely responsible for. Is it true that, even though I filed bankruptcy, that I still owe him for half of our bills, or is he trying to trick me???

Would it be a good idea for someone who has a recent BANKRUPTCY to apply for a car loan?

A friend declared Chapter 7 Bankruptcy last fall before the law change, and his debts were cleared and honestly I cant really say if it is a good idea or not for him to apply for a car loan as his first application for credit of any kind post-bankruptcy. I would tell him to look into credit counciling, but every site I have seen has some kind of a catch or is not entirely unbiased. The loan amount he wants is 15K for a late model used car. His income to debt ratio is excellent now, unlike a year ago when he was not recieving his pension.

If we file Chapter 13 bankruptcy to get some debt relief we’ll still have tons of school loans left to repay. We’re thinking of using our $13,000 credit card to pay off one of the school loans and then including that card in the bankruptcy. Are there any laws that would prevent this or is there any reason you can think of that this wouldn’t be a good idea?

I have read so many stories of non-custodial parents thinking that if they file bankruptcy, they will eradicate/ severely decrease the amount of child support that they have to pay. We all know that this is not true.
However, my Husband’s ex-wife is filing a summons and complaint to get more child support from him.
BUT SHE FILED AND WAS GRANTED BANKRUPTCY IN SEPTEMBER 2004, the month before the bankruptcy laws were changed(according to her 3rd and ex-husband, “the last month where you could financially get off scot-free”).
My question is this: does any one know how the CUSTODIAL parent filing bankruptcy affects, if at all, how much the non-custodial parent should pay in child support????

Just reiterating…
SHE, the custodial parent, filed bankruptcy….
we have always paid child support.
She just wants more now.
we pay $500/month + medical insurance plus half medical expenses.
Now she is asking for $697/month, retroactive from June 2007.
Meanwhile…… My Husband is sole provider for our household of 2 of our own children, and mine from my first marriage whose father hasn’t paid a penny of child support in 3 years.
We own our home and pay almost $2000/ month for mortgage.
And I’m trying to figure out the wherewithal that this woman has, thinking that her one child needs almost $700/month, especially since she has filed bankruptcy. WE haven’t.
I have the proof that she filed bankruptcy too, even though they may not look it up. I did, on background check!!!! Have my printed copy right here.

Does anyone else think student loans should be written off?

in bankruptcy just like credit cards and other debt? So shopoholics and gamblers can get off the hook but law abiding citizens who pursue higher education can’t? I’m not talking about federal backed loans, I’m talking about private student loans from places like CHASE, JP Morgan etc.

What does conditionally denied mean?
