Is the current credit crisis and housing slump due to the bankruptcy law changes made a year ago?

I can’t help but think that the changes weren’t the right ones. It seemed like it would have been better to limit how much above and beyond interest the creditors could charge than to make it harder for people to abandon their debt.

I recently found out my boyfriend who I’ve lived with for 7 months has an outstanding credit card debt of 5 k.This debt is all on a credit card he had 5 years ago he never paid off and they are now taking him to court. I’ve been working two jobs to get me and to some extent us out of debt we had incurred when I was off work sick for a few months and didn’t qualify for unemployment sick pay, and he had been laid off at a greatly lower rate of pay then he would normally make. All debt in my name is paid off, things in his name still aren’t (we both decided we would pay off out own accumulated debt). He is thinking of filing personal bankruptcy because of this added debt, and the fact he will be laid off in September and I am going back to school. I was wondering how this would affect me, first off at 7 months living together am I considered common law? Will I be ordered to pay any of this off? Will they make me sell my personal possessions I had before him living with me? (computer/car)
I am from Canada if that makes any difference. I was told by a couple of people that in Canada common law is established 3 months after living together (not sure if you have to have a child with the person to qualify). I am not sure how valid that is but would really like to know any potential ramifications before he decides to file.

which is better to do? credit cousleing or bankruptcy? also how did the bankruptcy laws chaange?

we have moved and are now having a hard time paying bills and most of our credit cards and personnal loans are 5 mths behind. we are at one (low) income and have no money to make these payments? any suggestions are welcome. i am looking for a job but in the meanwhile we are really hurting finacelly. we have even had to move in with my parents which is hard cause we have 2 children. i sure would like some help!

Has anybody filed CHAPTER 7 BANKRUPTCY with new laws? Can someone ex pained to me MEANS TEST and NEW YORK EX?

Hello, I went through lots of problems last year. I thought if I knew more of those laws….. about business, credit, bankruptcy and so on, it would have helped me alot.

I do not have plan to be a lawyer, but I would like to study those laws that would help me in long runs.

How should I study them?

Is it true that when you file a Chap 7 bankruptcy that the cancelled debt needs to be reported as income?

I filed for Chap 7 bankruptcy before the law changed in 2005. My house went into foreclosure but was covered in the bankruptcy because I knew I couldn’t afford to keep it even after the filing. I am of the understanding from the attny that I DON’T have to report this, but a CPA is sayin it is included. I am totally confused and wish that people in the legal field and cpas would make agreements on the law.

Why do lawyers(trustees) in Bankruptcy courts feel that the only people who are qualified to prepare?

While in college, I worked a few summers with a law firm in New York that specialized in bankruptcies.This was BEFORE the new law went into effect in October ‘05.
Yes some of the new paperwork is rather cumbersome and tedious but it is not impossible for a non-attorney to prepare the petition.
I did this as a favor.I made no mistakes, And her bankruptywasdischarged.
I gave her no legal advice at all. I simply prepared the paperwork based on what she provided to me. Plus she read a lot of the same information I did.

- taxes - internal revenue service which collects taxes in america is a privately owned company { yes u read that right } although the public are lead to belive it is part of the government . in 1863 the bureau of internal revenue was fromed to collect taxation , but in 1933 three members of the prescott/bush family helen and clifton barton and hector echeverria formed the internal revenue tax and audit service registered in deleware . side story - prescott bush is the father of george bush and the grand father of our current president . in 1953 , the original bureau of internal revenue was disbanded , leaving the privately owned internal revenue service to collect all the taxes .

i bet your thinking how did all this get started well my friend , to understand this we have to travel back in time to the first president george washington . { tune in some soothing music } when george washington became president he appointed alexander hamilton as his secretary of the treasury . hamilton introduced the bank to the united states , a privately owned central bank which began to lend money to the newly established u.s. government so creating control by debt { i think you can figure that out } . however the bank of the united states as it was called caused so much poverty , bankruptcy and rebellion that it was eventually closed down , but soon after came its replacement - the federal reserve . interesting to mention the bankers who wrote the bill for the united states bank were hated by the public because of what i mentioned above . however they are the same people that wrote the bill for the federal reserve , and whenever they were in public they vehemently opposed the bill for the federal reserve that they wrote themselves !!! it was clear manipulation as the public hated these guys and they were so unpopular that support for the federal reserve bill increased ten fold . the bill was then pushed threw congress just before christmas in 1913 when many congressman were at home with their families for the holidays . however to ensure an endless supply of funds for the government they introduced the federal income tax bill also in 1913 . they did this very sneaky as they needed an amendment { we know today as the 16th } and that required 36 states to agree . but philander knox , the secretary of state at the time simply announced that the required majority had been achieved and the bill was then introduced . to this day the federal income tax is illegal yet they continually get away with having americans pay .

- side note - there is no law { that’s right let me say that again } no law , that says americans must pay federal income tax but they go on paying year after year after year because they think they have to and those that know its illegal do so anyway because they are in fear if they don’t . as they would lose their house , business , car you name it .

the federal reserve the so called central bank of the united states isn’t federal nor does it have any reserve . the federal government of the united states does not own a single share in the federal reserve and the american people cannot purchase them . profits exceed 150 billion dollars a year and the federal reserve has not once , in all its history , published audit records .

Is there debt relief for military credit union loans?

Every debt relief company tells me they can’t help me because I have credit union loans from military specific companies. I am no longer enlisted, but it seems the only option I have is bankruptcy which, ironically, I can’t afford because of the new laws requiring upfront payment. Is there a company that can actually help me get back on track? Serious answers only, i.e. don’t waste my time.

I have a friend that is in the process of declaring bankruptcy and has a credit card garnishing her wages. She read on a legal aid site that they can only garnish wages after 320 dollars of paycheck, and only 15%. She is making about 300 and less and they are taking about 20% each check. Is this legal?
