bankruptcy law

I feel I’m drowning in debt and want to get my head above water. I went through a bad situation recently that caused me to get behind on credit cards and also to have to take out more credit just to survive… I’ve always been faithful and diligent about paying my bills and would hate to file bankruptcy but I don’t see another option…. just wonder if any of you out there know what the new criteria is on filing…. Thanks
how do I find out what the median income is in my area to see if I qualify to file
Current income is around 40,000 annually and really i have about 16,000 in debt with just credit cards. I have some medical bills that are around 6000. I have a 2nd mortgage around 30,000 that I DONT want to file on. I also have four children and my bills each month take most of my income.

Should I drop my judgment due to my creditors chater 7?

bankruptcy law

Two weeks before filing chapter 7 a customer signed and borrowed money from me. Two months after filing he amended his chapter 7 to include me in it. I never received any paperwork from him or his lawyer stating he was in chapter 7 nor did I receive anything from his lawyer until after the case was discharged.
His lawyer give me ten days to drop a judgment i have on him or face being taken to court myself for not abiding by bankruptcy laws.

I was not aware of the bankruptcy until my lawsuit was started. I never received anything in writing other than a letter after the bankruptcy was discharged. I have lost money already taking him to court and lending him money. I believe he was clearly aware of his chapter 7 before taking the loan. I don’t have money to pay a lawyer for representation. what can i do to protect myself and get my money back? Please help me, I dont want to lose anymore money.

Can bankruptcy effect the payment of child support?

My brother-in-law is a real piece of work. He has two children, neither one he takes cares of or presently pays child support for. However, he makes sure that every year he claims them on his taxes so he gets extra money back for them. The mother is now taking him to court to get child support. We found out the other day that he is going to declare bankruptcy to try to get out of paying the child support. Will it work?

Here’s the bill.
From Congresspedia:
The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (S.256), as passed, was introduced in the 109th Congress (2005-2006). The act made sweeping changes to American bankruptcy laws, affecting both consumer and business bankruptcies. Many of the bill’s provisions were explicitly designed by the bill’s Congressional sponsors to make it “more difficult for people to file for bankruptcy” in order to curb abuse. The act was passed by the 109th United States Congress and signed into law by President George W. Bush on April 20, 2005,

Bankruptcy Laws in Michigan?

bankruptcy law

I was thinking about filing for a chapter 7 bankruptcy. I have filed before, but I am unware of the new laws. The main reason for the filing is to rid myself of unwated medical and credit card bills. My chapter 7 bankruptcy was discharged in April of 2001 or 2002, can I file for a chapter 7 again? Or will I have to file for another chapter? I paid $1000 to file my first chapter 7, is it going to cost more now? Please help.

Did anyone hear about this? Russell Simmons calls Barack Obama a mouse?

“Simmons: “I think about one-fourth of his campaign contributions came from small donations made over the Internet, even though he collected more than any other Democratic candidate from Wall Street people. So at the end of the day, he’s controlled, too. That’s my point. He’s a mouse, too, like everybody else.”
It continues to say “Simmons is more right than he may care to know about Obama. Let’s start with his second point - “progressive” Obama’s mousy reliance on corporate political cash.
“Obama’s reliance on deep-pockets supporters is certainly part of why he opposed an amendment to the Bankruptcy Act that would have capped credit card interest rates at 30 percent.”
“The junior Senator from Illinois denounces the corrosive influence of private political cash on U.S. democracy while cozying up to Chicago’s notoriously corrupt Big Money Mayor Richard M. Daley (with whom he shares the same high-priced campaign consultant (David Axlerod) and raking in campaign largesse from wealthy world-capitalist interests. His top career sponsors include Goldman Sachs, Exelon (the world’s leading nuclear plant operator), the Soros Fund Management, J.P Morgan Chase & Co., leading corporate law and lobbying firms (Kirkland & Ellis and Skadden,”
