Real Estate Law/Mortgage Attorney Bad Home Loans?

I was given a very bad loan with a reputable bank “Wells Fargo” that is. They NEVER gave me Disclosures Good Faith,TIL Borrowers Authorization etc! They sold my loan to EMC and they changed my Interest rate from a FIXED rate when i signed my loan docs to an ADJUSTABLE rate of a 10% on my FIRST and a 12% ADJUSTABLE on my second WITHOUT even telling me!

I am pretty sure i have aREALLY good case! That is what EVERYONE is telling me! I was workingfor a company Prudential Real Estate when the wells fargo “Lender” that worked with me he had his own branch in my office told me i could get a home loan even though i was making COMMISSION only and probably only $1,000 a month. My Mortgage is $2,200 a month for a very small condo here in Modesto that was built in 1980 and is only worth $200k and they sold it to me for $235K. What i am upset about is what they told me and not disclosing ANYTHING to me i have ALL of my documents and no good faith etc was given to me and my Interest rate changed 3 points when they sol my loan to EMC. The Lender from Wells Fargo told me to write a letter saying i made $4,000 a month doing Notaries a month and that would get me the home loan! Well it Did and with a Hefty Price and a Mortgage I cannot afford and nobody will refinance me because i had to file bankruptcy because i could not afford the payments anymore at 27 years old on my own and only making $2k a month, and a Mortgage of $2,200 a month which is more than i make not including money i need to eat!!!!!

Please call me ASAP and i will explain in detail. I am afraid i will lose my home and i am frustrated because i keep getting the wrong answers from my NEW lender and my interest rate changed without my consent! I can be reached at 209-380-1004.

Would it be Godly for me to put this on a sign and protest in front of McDonalds?

From a literal interpretation of scripture, I could believe that those who are bankrupt or those that neglected paying back credict card debt or student loans are going to hell for stealing..if they die without ever repaying that money.

Again, should I put that on a sign and protest in front of a bankruptcy court?

Would you support a church where the pastor called fat people an abomination, or called a bankrupt person the scum of the earth?

As a gay man, I hear pastors/fundies use such language, and have seen them hold such signs as it relates to the homosexual.

So, the question is…why are you justified to use such rhetoric over interpretation of scripture as it relates to homosexuals…but, it would be disrespectful to use such language in relating to other sins based on interpretation of scripture?

Our fast food nation encourages gluttonous sinning..our lax bankruptcy laws allows
people to steal from corporations…

These things are big sins our world…and are encouraged every day…so, why not the public outcry?

Could it be that would be unpopular…and obesity and bankruptcy affects a larger percentage of people…so, fundies are afraid of alienating monetary contributors?

How does the Bankruptcy Reform Act 2005 effect me?

This is probably a very vague question, however I’m wondering what impact does the Bankruptcy Reform Act of 2005 have on people? (not those who lend money/credit).

How has the bankruptcy law changed since then?

I ask because I took a course in bankruptcy law in 2004 and literally two weeks after graduation the above mentioned law passed.

My grandma is 79, can’t work due to congestive heart failure, has roughly $800/month in retirement income. She owns her house with no mortgage or refinancing. She managed to get herself into over $10k in cc debt, most of it due to higher interest fees than minimum payments. Each month adds around $200 in interest on each card, which she can’t afford to pay. She has tried to get a home equity loan to pay things off a few times, but: Her credit score is too low, and/or she doesn’t have enough income. What is she to do being pushed further into debt. We live in Michigan, if bankruptcy is an option that would help, I’m pretty sure laws are different for each state. Is there anything she can do? Even if she wanted to sell her house, the real estate market here is so bad, I heard a few months ago over 80% of the city is for sale.
Her house is worth approximately $27k SEV or $59400 Market Value, if this would help in determining bankruptcy status.

Are divorce law and bankruptcy law lucrative fields?

I have heard that some some lawyers have made very good money in divorce law and/or bankruptcy law. They will advertise that they will “do” a divorce or bankruptcy for a few hundred dollars and then many people will call in for their services. I have also heard that divorces and bankruptcies are usually not too complicated. Any information would be great – I may be very misinformed.

Congress has passed billions of dollars in payments and subsidies to big oil companies , pushed through a corporate-written , consumer -crippling bankruptcy law .
They distract and divert public attention from profound issues such as , educating our youth , equatlity and the war against radical islamic terrorist that affect our daily lives .
They supported illegal immigration for the sake of cheap labor . Who benefits from that , Corporations , not the American Working Middle Class .
What if for this election we decided to declar war on both partys .
Decided to register as Independent .
For the first time , working middle class Americans might just get the attentionof the other two party’s in Washing ton .
The middle class has suffered in silence long enough .
We can’t afford to keep silent any longer .
We need to let the two partys know , that ” We are mad as hell and we are not going to take it any more ” !!!

I am drowning in debt. I have three kids and we rent a home now and are barely able to make the electric and water payments… we have a credit card and a car loan that are both threatening to sue me. I have nothing. There is nothing of value in my home at all. I don’t have the money to pay anything more that what HAS to be. If I consider bankruptcy, what will it take care of? Please be specific becuase I don’t know a lot about the new laws. Thanks for your help.

My daughters husband is a dreamer: goes from one job to another. He finally drove them into financial ruin by trying to operate a house gutter business. My husband & I have been buying groceries & paying some bills for them over the last year. They lost their health insurance & have 2 sons, one with diabetes & one with asthma. My son-in-law has ticked a lot of people off by not showing up for jobs & is being sued. He is not a nice person but seems to think the world owes him a living. We help our daughter & grandsons because it’s not their fault but have got to the stage where we think we’re enabling him by giving them money. It’s gotten as far as having to co-sign for our daughters car so she can get to work.
The S-I-L has now got a restaurant job but they are still in debt & talking about bankruptcy (again).
We have an unexpected bill ourselves this month & would like to get some money back (the $500 we lent him to buy a truck when his got re-possessed would be nice).

how long after bankruptcy can creditors continue to report “included in bankruptcy”?

In March 2006 the bankruptcy was discharged but creditors named in the bankruptcy still file new reports that say “included in bankruptcy” These new reportings are showing up on the “derogatory statements” section of the credit report. it seems that these hurt my credit – can the creditors report this nearly a year later? Seems like its just “sour grapes” on their part and I can’t imagine that the law would allow this – if you know or have a good place to find out the specifics on this particular issue would be helpful.
PS – My atty’s office is closed today or I would have tired him first. But I would like to start writting to the credit agencies today if there is something that I can and should be doing

The main point of my question is that there are NEW reports that the account was included in bankruptcy. Only these NEW reports show in the derogatory comments of my credit report – not the OLD reportings of “included in bankruptcy”. So it seems that a disgruntled creditor could create a new report each and every month – and literally destroy any rebuilding of my credit. That does not seem right or fair, and I’d like to know what protection I have against that? Let me know if you still don’t understand my question – maybe I have not stated it quite right.
