I need an example of a “Motion to Reinstate” for a bankruptcy case in Michigan?

Need an example for a Motion to reinstate case for a chapter 7 bankruptcy case that I am helping my son-in-law file. We missed the deadline for filing the credit counseling report with the court. When I explained to the help desk that we were in the process of getting the counseling, but that it would not get to the Bankruptcy Court until after the deadline, she stated to “just get it here asap.” This I did, but now the Judge has dismissed the case. I am trying to reinstate it and send the credit couseling certificate again to the court. Thank you for any help, stephanie

Is a debt or a judgement still discharged against a person, even if it is not listed in a bankruptcy?

I was just dropped by my bank in a home mortgage title preparation stage, when the title company found an old judgement against me from the year 2000. It was $12000 worth of old medical bills. I never knew the judgment existed and it wasn’t even on my credit report. However my bankruptcy was in 2002. As I understand it, if there was not property involved, that judgement, whether listed or not on the bankruptcy is discharged with all the other debt. I cannot afford, nor do I have the time now, to reopen this. If I could be pointed to the law for the Southern District of Indiana, it would be helpful. I haven’t found anything in my search.

tenant stuck in a lease?

Are there any options for getting out of a lease before the lease is up? I have tried subleasing, selling the business, etc… but no success because the building is over priced for the area however. I have been leasing for almost seven years and hit some hard business times. For approximately 3 months I have been paying less than the full rent after discussing my financial situation with my building manager but on Monday was sent a letter informing intent to evict. I do not have the money in any way, shape or form to pay for an early buyout (28K) but can come up with almost half of the money for that to occur. I do not want to file for bankruptcy (as my attorney suggested) but feel it may be the only solution to stop the management company from filing a law suit against me. Any suggestions?

This is long and complicated. I live in Ohio and I filed bankruptcy Oct 2005, right before the law changed. I went to court in Dec. It was discharged shortly after. Jan of 2006, a neighbor that I took care of passed away and left me and my husband the residue of his estate, which turns out to be quite hefty. I understand that we have to pay our creditors if we comeinto money within 6 months of BR. But, the Will is in probate being contested and BR attornies are trying to intervene to make sure they get there monies. By intervening, they are tacking on attorney fees that they have aquired in doing so. Now, I filed BR on only $17,000.00, but they are now wanting $75,000.00 because of the attorney fee’s and interest. Which by the way, we have not yet been given the inheritance because of the contest. My question is, Is this legal?? The law says if you come into money within 6 months of the discharge date you have to pay your creditors. we were named in will, but not gotten money yet.

When a public company files for Chap 11 bankruptcy, and its stock continues to trade. How much time does the law allows the company to come up with a bankruptcy plan? Where can I find the filings that the company sent to the court judge? What are the different legal steps and timeline, the company needs to go through before it can exit from chapter 11?

If you have filled a bankruptcy in 2000 and it discharged in May 2001 when can you start to file again?

WASHINGTON (AP) — The Supreme Court ruled Wednesday that a financially troubled small businessman gave up an important right under the federal bankruptcy code because he failed to disclose all of his assets as the law requires.

In a 5-4 decision, the court said Robert Marrama of Gloucester, Mass., could not convert his bankruptcy case from one chapter of the code to another, as the law ordinarily allows.
