Real Estate Law/Mortgage Attorney Bad Home Loans?

Sunday, October 5th, 2008
bankruptcy law

I was given a very bad loan with a reputable bank “Wells Fargo” that is. They NEVER gave me Disclosures Good Faith,TIL Borrowers Authorization etc! They sold my loan to EMC and they changed my Interest rate from a FIXED rate when i signed my loan docs to an ADJUSTABLE rate of a 10% on my FIRST and a 12% ADJUSTABLE on my second WITHOUT even telling me!

I am pretty sure i have aREALLY good case! That is what EVERYONE is telling me! I was workingfor a company Prudential Real Estate when the wells fargo “Lender” that worked with me he had his own branch in my office told me i could get a home loan even though i was making COMMISSION only and probably only $1,000 a month. My Mortgage is $2,200 a month for a very small condo here in Modesto that was built in 1980 and is only worth $200k and they sold it to me for $235K. What i am upset about is what they told me and not disclosing ANYTHING to me i have ALL of my documents and no good faith etc was given to me and my Interest rate changed 3 points when they sol my loan to EMC. The Lender from Wells Fargo told me to write a letter saying i made $4,000 a month doing Notaries a month and that would get me the home loan! Well it Did and with a Hefty Price and a Mortgage I cannot afford and nobody will refinance me because i had to file bankruptcy because i could not afford the payments anymore at 27 years old on my own and only making $2k a month, and a Mortgage of $2,200 a month which is more than i make not including money i need to eat!!!!!

Please call me ASAP and i will explain in detail. I am afraid i will lose my home and i am frustrated because i keep getting the wrong answers from my NEW lender and my interest rate changed without my consent! I can be reached at 209-380-1004.

Thank You!!!!

Sincerely,
Krissy Sutton

Bankruptcy Laws regarding 401k?

bankruptcy law

My husband lost his job this year and we may end up having to file bankruptcy. We both have 401k accounts and would be penalized if “we” use them. Can they be taken to satisfy our debts when we basically are not allowed to use them?

Can you please explain the difference between Chapter 7, 11, and 13 Bankruptcy?

Some cases, such as bankruptcy and patent, are heard only in federal courts?

Some cases, such as bankruptcy and patent, are heard only in federal courts. Do you think that having exclusive jurisdiction by federal courts in these subject matters is a good idea? Why or why not? Some cases are also only heard in state courts. For example, most family law cases are almost always heard in state court and not federal court. Is this a good idea? Why or why not?

Frivolous Law suites?

bankruptcy law

I have a lawyer who has represented me in four law suites filed over the last three years. The plaintiff has cost me over $50K defending myself. I have always won the court cases but can not recover any money because he declaired bankruptcy before starting these law suites. This person has now forged a documents (cut and pasted my signature) to start a new case. My lawyer asked for the original but he will not give them to us (because there is no original). He is asking the court to accept this copy as an original because “he says” he no longer has an original. In my state it is possable to use a copy of a contract as an original. He has lots of money (HIDDEN) so he and his family starts something new every time they loose a case. What can be done to stop him from filing another law suite against me? He is trying to break me financially. I would really appreciate your serious answer and help. Please Help if you can!

What are your thoughts on having a “maximum wage” as opposed to a “minimum wage”?

This would put a ceiling on the VERY rich only. Say there was a law that no company could pay any individual more than $5 million a year. Ideally, this would force the remaining surplus capital of the company back down the chain to its middle and lower-tier employees. Would this not greatly accelerate the “trickle-down” economics?
Just imagine if Ford Motor company wasn’t paying CEOs $200 million a year. Would they still be facing bankruptcy and borrowing from every bank possible?
