Bankruptcy. have the laws on it changed?

I’ve heard that declaring bankruptcy doesn’t necessarily free you of any outstanding debts anymore. Is this true? If so, what’s the point?

I’m not about to declare bankruptcy but this is a discussion some of us were having today.

Liberals: Can you state some good things that President Bush has done?

Here are 3, do you have any more?

1. Amnesty for Illegal Aliens.
2. Do not call list
3. Updated Bankruptcy law so an individual can keep more of his personal property when having his debts discharged in a a Title 11, Chapter 7 Bankruptcy

(Okay, technically the do not call list eliminate over a million jobs, but I don’t care. And I think Judge Small did most of the Bankruptcy revisions, but Bush signed off on it).
NOTE: The 1st amnesty did happen, the 2nd did not.
NOTE: Most of the Bankruptcy law revisions were done by Federal Bankruptcy judges. I think Judge Small was one of the primary contributors.
NOTE: Medical debts can be discharged under the new bankruptcy lawd just as before. Unlike non-secured credit debt, there is no 90 day period before filing that cannot be discharged.
rick m: You must really like long lines.

Wal-Mart to take over EVERY INDUSTRY?

bankruptcy law

Now I have talked to many people about this topic and a lot of them say (respected business people) that wal-mart is like K-mart and Woolworth and they will die eventually from under selling the suppliers and a bunch of other stuff. I am about 50 50 here however what they are trying to do as it is become apparent to me is to CRUSH and KILL AND SMASH you if your in business in the retail industry. That’s at least what the deal was until a few years ago now they want to do it to more industries. My cousin wants to become a doctor and he told me that they are trying to open clinics now in some of them (medical industry) so here they go with another industry trying to SMASH you there eventually to go see the doc you might have to go to wal-mart. What’s worse than this? They tried to take over the banking industry too, I was reading that they were trying to buy out banks and I think it was some large bank but thankfully the government passed a law that said that they couldn’t do that but knowing wal-mart they will keep twisting arms until they get what they want. Speaking of which they twist the arms of public officals to get the massive amount of land they need for their stores I mean think about it; do you think I could buy a business that
large even if I had the money? NOPE: environmentalist would be on me in a flash but wal-mart has a way of manipulating people. Also many suppliers like valasic pickles have had to declare bankruptcy due to their limitless demand from them to get lower prices lol. So there we have it are they bound to take over one industry after another? CRUSH KILL DEMOLISH SMASH YOU!! That’s their goal if you want to take on the responsibility of one of the greatest things
in this country being an entrepreneur. So just don’t start your own business or anything they already have food stores in some of these wal-marts so you might not even be able to start something in the restaurant and food industry. Anyway opinions??

Debt question?

bankruptcy law

Wondering if a debt collection agency, or law firm dealing with a debt problem with me are allowed to garnish my wages, take me to court or take my posessions for collateral. I heard once that the only people who can do any of the above by law is the IRS and that no other agency can do it.

Only one of my debts is tied to a posession of mine, my truck which is in with a bank loan which Im currently paying on. But alot of my debt has gone to collection agencies (alot of them I have already worked out payment plans, some of them just dont want to deal with me), its those that Im paranoid about.

Any help with this issue I have would be greatly appreciated, and if there is a website that lists the laws that state any answers would be greatly appreciated. Thanks.

Also before anyone gives me crap about not paying what I owe, Im not trying to get out of debt by not paying or filing bankruptcy, Im just having a hard time getting people to work with me. Thanks again.
I do have a job, just cant afford to pay all my debt all at once. I cant afford to pay off debts, just pay on until they get paid off.

Also I live in Texas.
Also my truck is in with a bank loan I have, the loans not a problem. Just a bunch of other loans and credit cards. I am enrolled in credit solutions, they are helping alot, but the debts they couldnt take I am having to pay off myself, and those are the debts I am wondering about.

I just want to know if a debt collection agency or law firm have the right in the state of Texas to garnish my wages or take my property, I have nothing tied to these debts, just my signature.

What is the justification for illegal immigrant behavior in the USA?

Some citizens: Get welfare~break laws~do drugs~get unemployment~get retirement~get disability~file bankruptcy~are lazy
Welfare~ is FOR AMERICAN citizens, PAID by American citizens
Lawbreakers~ are punished by fines or imprisonment
Drug addicts~ are dealt with through de-tox or they live miserable lives. Our problem, not Mexicos or Mexicans problem.
Unemployment and retirement~are paid by each person and they reap according to what they paid in or earned previously.
Disablilty~provided FOR citizens and must be proven.
Bankruptcy~A legal procedure, paid for in legal fees. A right if needed by citizens.
Lazy~there are lazy people in all cultures and Nationalities. Most Americans are NOT lazy. That is a generalization by some people who have not travelled across this country and seen how hard Americans work. The southwestern part of the USA is only a small portion.
Illegal immigrants use the above mentioned as reasons or justification for abusing our laws or our welfare.

Those programs were set up for CITZENS of the USA , not illegal invaders. How can they justify their abuses?

bankruptcy law

My close relatives are thinking about declaring bankruptcy, they’re at least 100-150 thousand dollars in debt. They can just make the minimum payments, and sometimes not even, and now one of them isn’t working so, doesn’t seem to be much hope for them. They also have a very large mortgage, and are forced to sell their house. The house is in both their names (they’re married). Some of their credit cards are joint accounts, like they both have cards with the same number. If they declared bankruptcy, could one of them just do that, rather than both of them? The majority of the money that they owe is on the husband’s credit cards, but some of the money like I said is joint. Any advice on that, from anyone that’s been through it? Any good bankruptcy lawyers agencies in the Los Angeles area? Thanks. :o)

Obscure Texas law makes a married authorized user liable?

bankruptcy law

My friends are married. Years ago, the wife opened a credit card account and listed her husband’s name without his knowledge, signature, or permission. She racked up a debt and stopped paying, so the creditors are going after both. She just filed for bankruptcy so her end is clear, and now the CC is about to take it to court. Normally, he would only be liable if he was a joint account owner, but according to a cheap attorney, there is an obscure Texas law that says he is because they are married. Is this true?
